UNCITRAL Committee

About this Committee

IWIRC is a NonGovernmental Organizations invited to participate in the meetings of the Insolvency Working Group to the UN’s Commission on International Trade Law. The Committee reviews proposed legislation and commentary internally, prepares comments to the proposed materials for submission to the UN Secretariat and UNCITRAL commission members, and attends expert group meetings and prepares presentations when invited to by the UN. A group of 5 of our members participates at the UN sessions twice each year by topic based upon the members’ ability to commit to attending continuous week long sessions in Vienna and NYC. Participation in our Committee would mean taking an interest in international law that is proposed from time to time, and participating in meetings from time to time. 

The UNCITRAL Committee serves as a technical expert participant in the meetings of the UN’s Commission on International Trade Law (UNCITRAL) Working Groups. The two working groups are: 

  1. Working Group V (insolvency); and 
  1. Working Group II (dispute settlement).  

The committee is responsible for reviewing proposed legislation and commentary, preparing comments for submission to the UN Secretariat, coordinating IWIRC’s delegation to UNCITRAL Working Groups II and V meetings, and acting as a liaison with other NGOs and Member Nations regarding insolvency and dispute settlement law developments.  

Specific responsibilities include: 

  • Reviewing and analyzing proposed UNCITRAL legislation and commentary internally. 
  • Preparing and submitting IWIRC’s comments and proposals to the UN Secretariat and relevant working groups. 
  • Liaising with other NGOs, Member Nations, and stakeholders to propose text, comments, or changes to Model Laws. 
  • Organizing events and meetings to broaden IWIRC’s relationships and influence. 
  • Contributing to ad hoc sessions on emerging topics such as cryptocurrency and related technology, as invited by UNCITRAL.

Members of the Committee 

The opportunity to serve on the Committee is available to all IWIRC members. There is no limit on numbers as to who can serve on the UNCITRAL Committee and we welcome contributions from all members across all continents as this significantly contributes to IWIRC’s standing at UNCITRAL – being a truly international organisation. The Co Chairs regularly refresh the Committee members and in doing so ask for IWIRC members’ qualifications to serve on the Committee.   

All members of the UNCITRAL Committee must be members of IWIRC and must sign and agree to be bound by IWIRC’s Code of Conduct and Ethics.
